Official Rules for the DirectDrive® Challenge II Sweepstakes

No Purchase Necessary. A Purchase Will Not Increase Your Chances of Winning.

  1. Eligibility: The Sweepstakes is open only to legal residents of Alabama, Arkansas, Florida, Georgia, Illinois, Louisiana, Missouri, Mississippi, North Carolina, South Carolina, Tennessee, Texas and Virginia who are at least eighteen (18) years old and are new users of the DirectDrive® App. Employees of Mitchell Communications Group, Direct Administration, Inc. (“Sponsor”), their affiliates as well as the immediate family (spouse, parents, siblings, and children) and household members of those employees, are not eligible to enter.
  2. Entry Period: The Sweepstakes begins at 12:00 AM Central Time on June 2, 2015 and ends at 11:59 PM Central Time on June 30, 2015 (the “Entry Period”). Entries submitted before or after the Entry Period will not be eligible. Sponsor’s computer is the official time-keeping device for the Sweepstakes.
  3. How to Enter: There are three (3) ways to enter the Sweepstakes described below, all of which are free.
    1. Download the DirectDrive® app and set up an account. Once your account has been set up, you will automatically receive one (1) entry into the Sweepstakes. Each pre-existing DirectDrive® account holder will be given automatically one (1) entry into the Sweepstakes.
    2. Visit http://www.directgeneral.com/news-and-events/2015/01/direct-drive-sweepstakes.aspx and complete the entry form by providing your name, address, phone number, and valid e-mail address.
    3. By hand printing your name, complete address, phone number, valid email address if you have one, and sweepstakes name on either a 3 1/2" x 5" postcard or separate piece of paper no larger than 8 1/2" x 11", and mailing to Sponsor’s Address. Mailed entries must be post marked no later than June 30, 2015. Sponsor will discard any mail-in entry form which is not completed in its entirety or is otherwise noncompliant.
    LIMIT ONE (1) ENTRY PER PERSON FOR THE DURATION OF THE PROMOTION PERIOD, REGARDLESS OF METHOD OF ENTRY. Entries received in excess of the stated limitation will be void. Registration forms must be completed in their entirety. Each valid entry received, regardless of the method of entry, will have an equal chance of winning.
  4. Drawings: On or about July 6, 2015, Sponsor will select one (1) potential winner in a random drawing of all entries received. The odds of being selected depend on the number of entries received. Sponsor will attempt to notify the potential winner within three (3) days of the drawing.
  5. Prize: One (1) winner will receive a Wal-Mart® Gift Card in the amount of Five Hundred Dollars ($500.00). The winner is responsible for paying any applicable income taxes and any and all other costs and expenses not listed above. Any prize details not specified above will be determined by Sponsor, in its sole discretion. A prize may not be transferred and must be accepted as awarded. A winner may not request cash or a substitute prize; however, Sponsor reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason, as determined by Sponsor, in its sole discretion.
  6. Sponsor's Rights to Entries: By submitting an entry, you irrevocably grant Sponsor, its agents, licensees, and assigns the unconditional and perpetual (non-exclusive) right and permission to copyright, reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use entrants twitter information, profile picture, leader board score and screen shot of entrants drive as-is or as-edited (with or without using your name) in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from you or any other party.
  7. General Conditions: Except where prohibited, a potential winner may be required to complete and return an affidavit of eligibility and liability/publicity release. If a potential winner fails to sign and return these documents within five (5) business days or is otherwise found to be ineligible, an alternate potential winner may be selected in his/her place in a random drawing of all remaining entries received. Only three (3) alternate potential winners may be contacted. In the event that the operation, security, or administration of the Sweepstakes is impaired in any way, Sponsor may, in its sole discretion, either: (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes; or (b) award the prize at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Sweepstakes, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt of that communication. In the event of a dispute as to the owner of an online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the owner. The Sweepstakes is subject to federal, state, and local laws and regulations and is void where prohibited.
  8. Release and Limitations of Liability: By entering, you agree to release and hold harmless Sponsor, their respective parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors, including poor cell phone receipt; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury or damage to persons or property. You further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
  9. Privacy and Publicity: The information you provide when you enter is provided to Sponsor, not to Twitter, and will be used in accordance with Sponsor's Privacy Policy.
  10. Disputes: You agree that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Tennessee. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of Tennessee, without giving effect to any choice of law or conflict of law rules (whether of Tennessee or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Tennessee.
  11. Sponsor: The Sweepstakes is sponsored by Direct Administration, Inc., 1281 Murfreesboro Road, Nashville, TN 37217. Twitter and Wal-Mart are not sponsors of or affiliated with this Sweepstakes.
  12. Results: For the name of the winner, please send a self-addressed stamped envelope to Direct Administration, Inc., 1281 Murfreesboro Road, Nashville, TN 37217, Attn: Deborah Butler. Requests must be received no later than thirty (30) days after the end of the promotion.

  3. How to Enter: To participate, you must have a DirectDrive® Account. If you do not already have an account, download the DirectDrive® app and set up an account. Start logging your trips using the DirectDrive® app (a trip must be a minimum of one (1) mile in length to be logged). All scores logged through the app will be added to a leaderboard on DirectDriveChallenge.com.
  4. Rights to Entries: By submitting an entry, you irrevocably grant Sponsor, its agents, licensees, and assigns the unconditional and perpetual (non-exclusive) right and permission to copyright, reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use the entry as-is or as-edited (with or without using your name) in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from you or any other party.
  5. Judging:This Contest will have Weekly Winners and Grand Prize Winners at the end of the Contest, During the Entry Period, each individual user’s scores logged through the DirectDrive® app will be added together to determine:
    1. Weekly Winners. The three registered drivers who have logged the highest individual scores using the DirectDrive app by 11:59 p.m. on each of the following Mondays during the Entry Period will each win a $50.00 Walmart® Gift Card:
      • Monday June 8, 2015
      • Monday June 15, 2015
      • Monday June 22, 2015; and
      • Monday June 29, 2015
    2. Grand Prize Winners. At the end of the Contest, the registered drivers who have logged the top five (5) cumulative scores overall, will be awarded the following:
      • First Place: $500 Walmart® Gift Card
      • Second Place: $200 Walmart® Gift Card
      • Third Place: $100 Walmart® Gift Card
      • Fourth Place: $100 Walmart® Gift Card
      • Fifth Place: $100 Walmart® Gift Card

      In the event of a tie: the driver with the fewest “hard stops” during Entry Period will be awarded the applicable prize.

      Winners are responsible for paying any applicable income taxes and any and all other costs and expenses not listed above.   6. Requirements of Potential Winners: Except where prohibited, a potential winner may be required to complete and return an affidavit of eligibility and liability/publicity release. If a potential winner is a minor, his/her parent or legal guardian will be required to sign the documents on his/her behalf. If a potential winner fails to sign and return these documents within the required time period, an alternate potential winner may be selected in his/her place according to the Judging Criteria. Only three (3) alternate potential winners may be contacted.
  7. General Conditions: In the event that the operation, security, or administration of the Contest is impaired in any way, Sponsor may, in its sole discretion, either: (a) suspend the Contest to address the impairment and then resume the Contest; or (b) award the prizes based on the Judging Criteria from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Contest, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
  9. Privacy and Publicity: Any information you provide when you enter the Contest will be used in accordance with Sponsor’s Privacy Policy. Except where prohibited, participation in the Contest constitutes your consent to Sponsor’s use of your name, likeness, voice, opinions, biographical information, and state of residence for promotional purposes in any media without further payment or consideration.
  10. Disputes: You agree that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Tennessee. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Tennessee, without giving effect to any choice of law or conflict of law rules (whether of Tennessee or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Tennessee.

  12. Results: For the names of the winners, please send a self-addressed stamped envelope to Direct Administration, Inc., 1281 Murfreesboro Road, Nashville, TN 37217, Attn: DirectDrive Challenge Contest Coordinator. Requests must be received thirty (30) days after the end of the Contest.
